Many Workers at ACS Upset About Overtime.
Some ACS employees could use some overtime to put some more money in their
pockets and are glad to work all the overtime they can get.  However, what can be
done about too much mandatory overtime?

Some ACS workers actually have families that they would like to see once in a while
or may also have a class schedule they have to show up for every now and again.  
We have recently been asked by some ACS employees several questions regarding
overtime such as:

  • Are there any laws that require ACS to give employees a certain amount of notice
    when they demand overtime be worked?
  • Can ACS even require employees to work overtime?
  • Can an employee be fired for refusing to work overtime?

Unfortunately, the Fair Labor Standards Act (FLSA) does not limit the number of
hours per day or per week that employees aged 16 years and older can be required
to work.  It also states that an employer may change an employee's work hours
without giving prior notice or obtaining the employee's consent (unless otherwise
subject to a prior agreement between the employer and employee or the employee's
representative).  The only requirement is that the employer pay the employees a
rate of 1-1/2 times their regular rate of pay for all hours worked in a week over 40.

The bottom line here is that there aren't many Federal or Utah State Laws that
protect workers from being required to work most every waking hour.  However,
another Federal Law called the National Labor Relations Act protects employees'
rights to join together with their co-workers and let their collective voice be heard
to improve their conditions in their workplace.  By joining together, employees can
gain the negotiating power they need to have a say in the way they are treated by
ACS.  They pay you for time out of your life.  Shouldn't you have the final say on how
